The main legislation that the Air Accident Investigation Unit operates under is SI-460, which came into effect on 9th December 2009 and is entitled AIR NAVIGATION (NOTIFICATION AND INVESTIGATION OF ACCIDENTS, SERIOUS INCIDENTS AND INCIDENTS) REGULATIONS, 2009.

S.I. 460 of 2009 replaces S.I. 205 OF 1997, however, Accidents and Incidents which occurred prior to 9th of December 2009 will continue to be investigated under the provisions of S.I. 205 of 1997.  Accidents and Incidents which occurred from 9th December 2009 inclusive, will be investigated under the provisions of S.I. 460 of 2009.

The following legislation, SI-206, was also enacted to give effect to certain provisions in SI-205.
SI-206 is entitled AIR NAVIGATION AND TRANSPORT (APPLICATION OF REGULATIONS TO STATE AIRCRAFT) (MINISTERIAL) ORDER, 1997
